1. The organizer of the Competition „Miles Champion“ is Earth Television Network GmbH, Osterwaldstr. 10, 80805 Munich, represented by Thomas Hohenacker (CEO), Michael Maucher (CEO).

Start of the Competition: August 2nd 2010, 18:00 o’clock CEST
End of the Competition: October 1st 2010, 18:00 o’clock CEST

2. By way of participating in the Competition the user accepts and agrees to these rules and conditions of participation.

3. The participation in the Competition “Miles Champion” is free of charge and optional and does not depend on the purchase of any goods or services. Every person of full age is eligible for participation. The number of participants is unlimited. Employees of earth television network GmbH or affiliated companies and persons entrusted with the realization of the Competition and their family members shall be excluded from participation.

4. In order to be able to participate in the Competition you need to have access to an adequate computer with a browser and Internet and Email access. In order to save the Competition-Miles and to continue collecting them during your visits, you need to register at earthTV.com for the competition “Miles Champion” and you need to stay logged in during the procedure. You can register and login to the Competition from August 2nd 2010 until October 1st 2010, 18:00 o’clock. All registrations have to be made and received by earth television network GmbH in full during this period.

5. Each Participant shall only be allowed to participate once in the Competition. Participant is, whoever owns the email address stated in the registration. Registrations for third parties or for groups are not admissible. earth television network GmbH reserves the right to exclude participants from the Competition, if they have committed an act of manipulation or have tried to do so. In this case the Prizes might be denied in retrospect at earth television network GmbH’s own discretion. earth television network GmbH further reserves the right to terminate or disrupt the Competition at any time, especially in the event of a failure of or interference with the orderly function of the Competition and in the event of any difficulties, that might have an impact on the integrity of the Competition.

6. earth television network GmbH shall not be liable for any technical problems, especially for breakdowns of the telephone or computer networks, the electronic system or the computer itself. earth television network GmbH shall further not be liable in respect to the condition, suitability, availability, correctness, reliability, marketability and / or the legality and configuration of the content, of itself and the Internet and of any public lines and/or network providers.

7. Rules of the game:
Each click on a camera location leads to a credit of miles. The amount of miles credited depends on the linear distance between the two camera locations. Some destinations are considered as summer locations. Miles from any location to an summer location will be counted double. In order to be credited the miles you need to visit the camera locations for 10 consecutive seconds each, i.e. the video has to run for at least 10 seconds. Delays with the building-up of a page are not counted.

The competition miles are accredited as soon as you are logged-in. The users with the currently most Competition-Miles are listed with their user name on the Competition website. Whoever finds himself or herself on the top of the list on October 1st 2010, 18:00 o’clock p.m. CEST is the winner of the 1. Prize. In the event that there are two or more participants with the same amount of competition miles then the positions will be drawn. Example: in the event that there are two winners then they will take part in a drawing for the first and second prize. And the other participants are moving one prize down.

On the top of the Competition website you can see how many Competition-Miles you have collected so far. You can also see how many miles in total you have collected, including the ones collected outside the ambit of the Competition – for the Competition, however, only the Competition-Miles are counted i.e. only the ones collected during the term of the Competition, so from August 2nd 2010, 18:00 o’clock CEST until October 1st 2010, 18:00 o’clock CEST.

8. Prize:

5. - 10. Prize: an „earthgrooves Vol. 2“ CD each

9. Only the above Prizes are awarded according to the collected Competition-Miles. Only those participants of the Competition can receive a Prize, who have personally, completely and correctly filled in and sent over to earth television network GmbH, all necessary fields of the registration. After the end of the Competition the winners are informed via an E-Mail notice sent to the E-Mail address stated in the registration.

10. Each winner is obligated to confirm the receipt of the notice without delay towards earth television network GmbH, at the latest 14 days after receipt of the notice and he or she shall also be obligated to give all information needed by earth television network GmbH for the awarding of the Prizes. Otherwise earth television network GmbH reserves the right, to appoint another winner or to forfeit the Prize. By accepting the Prize the winner authorizes earth television network GmbH and its affiliated companies to use and exploit his or her name and picture free of charge in the Internet.

11. In the event that it is not possible to send a notice to the winner, earth television network GmbH reserves the right to appoint another winner or to forfeit the Prize.

12. The formalities in respect to the awarding of the Prize shall be agreed with the individual winner. The winner shall be responsible for a potential trip and for travel expenses, board and lodging, especially if the awarding of the Prize requires such a trip. As far as the Prizes constitute chattels, they will be sent out to the winner via post to the address stated in the registration. At the time of posting the Prize the risk passes over to the winner. earth television network GmbH shall not be liable for transport damages.

13. It is not possible to award the Prizes in cash, in material assets, and it is not possible to swap the Prizes. The Prizes are not transferable. The winner shall accept changes to his or her Prize, in so far as they are necessary due to factors outside the sphere of influence of the persons and companies involved in the realization of the Competition. All taxes and charges in connection with the receipt and use of the Prizes shall be borne by the respective winner.

14. earth television network GmbH reserves the right to change these conditions of participation without prior notice.

15. Any claims for damages, irrespective of their legal basis, that are brought against earth television network GmbH, its organs, employees and other staff and/or against any affiliated companies deriving from or in connection with the Competition, are limited to intent and gross negligence insofar as this is legally admissible,.

16. The personal data that you have given earth television network GmbH in connection with the Competition shall only be used in connection with the Competition and shall not be passed on to third parties with the exception of affiliated companies and companies who need to know those data in order to realize this Competition. earth television network GmbH shall not be liable for the loss or damage of any such data during the data transfer or after it. 17. All data shall be deleted if a participant applies for it in writing or revokes his or her registration. The participation and registration in the Competition can be revoked at any time by sending an email to contact(at)earthTV.com

18. The Competition and these conditions shall be subject to the laws of Germany. No recourse to legal action is permitted.
